TERMS AND CONDITIONS
1. Service Agreement and Card Submission
Authentication and Grading
Services Provided: Customer submits Cards for evaluation by Mint Authentication. Mint Authentication will use its best practices and internal standards to determine the authenticity, grade, and condition of each Card.
Right to Reject: Mint Authentication reserves the right, in its sole discretion, to reject any Card that does not comply with Mint Authentication’s current standards or submission guidelines. No refunds for service fees will be issued for Cards that have been received, tracked, examined, or researched, even if Mint Authentication is ultimately unable to authenticate or grade them.
Submission Process
Customer Responsibility: Customer must accurately and completely fill out the Submission Form and package and ship all Cards in accordance with the published submission guidelines.
Description Corrections: Mint Authentication reserves the right to adjust or correct any Card description provided on the Submission Form, including but not limited to spelling, year, make, parallels, numbering, or description. These corrections will be made without notification to ensure the accuracy of the authentication label displayed on the Card holder.
Third-Party Submissions
Affiliate Submissions: If an Authorized Affiliate submits Cards on behalf of a third party, the Affiliate certifies that the third party has authorized the Affiliate to submit the Cards for the Services.
Individual Submissions: Individual Customers may not submit Cards on behalf of a third party unless they have first been designated and approved by Mint Authentication as an Authorized Affiliate.
2. Card Alteration
Customer represents and warrants that they have no knowledge and no reasonable belief that any Card submitted for Services is counterfeit, not genuine, or has been subject to Altering or Restoration.
“Altering” includes, but is not limited to, trimming, coloring, soaking/bleaching, erasing, removing holes or creases, polishing, waxing, filling, or any other method used to change or enhance the appearance, condition, or grade of a Card.
Consequences of Alteration: Customer acknowledges that submitting an Altered Card is a violation of this section and may result in additional research, handling charges, and return fees as deemed appropriate by Mint Authentication.
3. Payment and Lien
Payment Due: Customer agrees to pay Mint Authentication for all service fees at the time of submission.
Security Interest and Default: In the event of returned, declined payments, or unpaid balances (including additional fees, handling charges, and return shipping), the Customer grants Mint Authentication a controlling interest (a lien) in the submitted Cards to secure payment of all outstanding service fees.
Retention of Cards: Mint Authentication will hold any Cards submitted until the Customer has paid all outstanding balances in full.
Forfeiture: If the outstanding balance is not paid within 90 calendar days of Mint Authentication receiving the submission, Mint Authentication will then take full ownership of all Cards in the unpaid order.
4. Liability, Insurance, and Risk of Loss
Customer Risk of Loss
The Customer assumes all risk of damage or loss to the Cards until they are physically received and inspected by Mint Authentication at its designated facility. Services are considered to begin at the time of Card submission by the Customer.
No Changes: Once delivery is made to Mint Authentication, submissions cannot be changed or canceled by the Customer.
Mint Authentication Liability
In the event a Card is damaged due to Mint Authentication’s negligence or is lost while in Mint Authentication’s physical possession, Mint Authentication’s liability will be limited to its determination of the fair market value (FMV) of the Card at the time of loss or damage, based on Mint Authentication’s assessment of current market value. This compensation will not exceed the Customer’s declared value on the submission form, unless otherwise required by law.
Holder Removal Services: For Services requiring a Card to be removed from an existing holder (e.g., holder replacement, regrading, crossovers), the Customer understands that holders are tamper-resistant and removal carries an inherent risk of damage. By requesting these Services, the Customer agrees to waive and release Mint Authentication, its directors, agents, and employees from all liability for any loss or damage incurred during the holder removal process, except in cases of gross negligence by Mint Authentication.
5. Shipping and International Submissions
Shipping Responsibilities
Insurance: The Customer is solely responsible for declaring the proper values and ensuring the appropriate insurance coverage for return shipping on the Submission Form. Mint Authentication is not responsible for any uninsured values or compensation for uninsured amounts.
Post-Shipping Liability: Once authenticated/graded Cards leave Mint Authentication’s facility under the care of a designated shipping carrier, Mint Authentication is no longer responsible or liable for loss or damage.
Incorrect Shipping Information: Mint Authentication is not liable for lost shipments resulting from incorrect contact or shipping information provided on the Submission Form. The Customer must notify Mint Authentication immediately via the support email if any contact or shipping changes are made.
Returned Packages
If a package is returned to Mint Authentication due to incorrect shipping information, a $30.00 USD handling fee plus all associated re-shipping costs will be added to the Customer’s invoice.
Returned Package Forfeiture: Cards returned to Mint Authentication will be held for a maximum of 90 calendar days. After 90 days, Mint Authentication will take full ownership of all Cards in the returned order.
Shipping Insurance Claims
Customer must inspect all packages upon delivery. If a package appears damaged, pictures must be taken prior to opening. Pictures of any resulting damaged items are required to file a shipping insurance claim.
International Submissions
For all international submissions, the Customer must be listed as the “importer of record” and is solely responsible for all associated customs duties, taxes, and fees.
Any additional duties, taxes, or fees arising from an international submission will be added to the Customer’s invoice, plus a $30.00 USD administrative fee.
6. Digital Images and Data Use
Grant of License: During the performance of Services, the Customer authorizes Mint Authentication to capture and compile digital images and data of the submitted Cards.
The Customer grants Mint Authentication an irrevocable, non-exclusive, unlimited, and royalty-free right and license to use and commercialize such data and images for any purpose, including but not limited to marketing, data reporting, and population reports.
